Medico-Legal Services

Rehabilitation consultant services support litigation and arbitration following injury for cases involving personal injury, medical malpractice and human rights. Assessments draw upon a range of information including medical records, client/collateral interview, standardized tests and clinical observations. Many of our consultants have been accepted as experts in Occupational Therapy and specific functional areas such as Life Care Planning, Functional Capacity Evaluation and Ergonomics by the Supreme Court of British Columbia and the Worker's Compensation Appeals Tribunal.

Cost of Future Care Assessment / Life Care Plan

Future care requirements for the long-term are carefully determined through comprehensive evaluation by consultant therapists skilled in life-care planning. The amount of support and assistance required to attain pre-accident level of functioning is clearly outlined in future care costs. Equipment, home modifications, attendant care, homemaking, childcare, travel assistance and other client requirements are addressed.

Functional Capacity Evaluation (FCE)

A 1-2 day comprehensive evaluation determines the client’s current functional capacity and identifies transferable physical skills. The assessment relies on standardized, criterion referenced and activity simulation tests to build a profile of client abilities & limitations that can be used to generate realistic vocational options or evaluate the suitability of potential training and employment programs. Assessment findings can also be compared against a variety of non occupational activity demands including homemaking, childcare and leisure activities. Assessment addresses body dexterity, muscle strength, range of motion, postural tolerances, fingering and handling, lifting, carrying and other abilities. Evaluation of physical effort, reliability of symptom and disability reports and stability of function qualifies findings. In addition to determining client abilities and limitations, FCE can also identify specific rehabilitation services and aides that may enhance or help maintain client function.

Functional Driving Evaluation

Cognitive, perceptual, behavioural, visual and physical core skills are assessed to determine impact on operational, tactical and strategic driving. A battery of validated tests is used to assess skill deficits prior to proceeding on-road. Driving performance and ability to compensate for identified skill deficits is assessed in-clinic and on-road testing. All vehicle classes can be assessed including ability to operate motorized equipment such as forklifts and excavators.

Case Management

Medical and rehabilitative expertise combined with a sound working knowledge of the health care system ensure recommendations for effective and appropriate services for clients are provided in a timely fashion. Communication with and between healthcare team members is initiated and maintained to facilitate a well coordinated response to the clients rehabilitation and medical needs. The goal of this service is the client's access to the 'right care at the right time'.

Evidence Review

Our experts are available to provide fair and reasonable critique of opposing counsel's rehabilitation expert reports to prepare for cross examination or mediation. We can identify when conclusions and recommendations do not reasonably follow from assessment results and the evaluation context. These and other findings are communicated with clear and plain language in a concise report. Related consultation includes the development of questions for cross examination and the provision of opinion regarding video surveillance evidence in relation to expert findings of ability and limitation.
